The family of the late Tijuana Frazier was awarded $3.8 million in reparations following a tragic incident at an apartment complex managed by Contour Eastwyck. The Fatal Incident

In 2022, Tijuana Frazier was shot and killed at her residence in an apartment complex in Atlanta. Her estate filed a lawsuit against Eastwyck, alleging that the company’s willful neglect allowed for violent crimes to frequently take place within the complex, ultimately ending in Frazier’s unfortunate death. The argument presented suggested that repeated crimes and the company’s apparent disregard for residents’ safety amounted to a level of willful misconduct contributing to Frazier’s death.

The Court’s Ruling

Over two years later, in March 2024, the jury concluded the trial in favor of Frazier’s estate. The verdict included $1.8 million in compensatory damages for her conscious pain and suffering due to Eastwyck’s alleged willful misconduct, along with punitive damages totaling $2 million.

Mike Rafi of the Rafi Law Firm in Atlanta, the plaintiffs’ counsel, shared his perspective on the jury’s decision. “I think the jury concluded that companies shouldn’t make a profit when they result in people being killed or severely injured, and that makes a lot of sense,” he said. “They didn’t want a company making money when their behavior disregarded such obvious problems.”

Financial Recovery Obstructed by Insurance Lawsuit

Despite the victory, Frazier’s family is currently unable to recover the financial restitution awarded to them. The complex’s insurer has additionally filed a lawsuit, taking a stance that could keep the family from recovering damages. The circumstances and the specifics of this second suit are still unfolding, but it demonstrates the complexity often involved in such legal battles.
